  1. ABOUT THESE TERMS

These Terms of Service govern your use of the Pixel & Pull website at pixelandpull.com and any purchases you make through it.

The website and store are operated by HYPERSTOCKUK LTD, trading as Pixel & Pull. References to “Pixel & Pull”, “we”, “us” and “our” mean HYPERSTOCKUK LTD.

By using our website or placing an order, you agree to these Terms. If you do not agree, you must not use the website.

Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded or limited.

  1. USING OUR WEBSITE

You must use our website only for lawful purposes.

You must not:

  • Use the website fraudulently or unlawfully.

  • Attempt to gain unauthorised access to the website, customer accounts, servers or connected systems.

  • Introduce viruses, malware or other harmful material.

  • Scrape, copy or reproduce substantial parts of the website without permission.

  • Interfere with the operation or security of the website.

  • Use false information, another person’s identity or a payment method you are not authorised to use.

  • Place orders with the intention of committing fraud, abuse or payment-card misuse.

If you are under 18, you may use the website only with the involvement and permission of a parent or legal guardian.

We may suspend or restrict access where reasonably necessary to protect customers, our business, Shopify or our service providers from suspected fraud, abuse, security threats or unlawful activity.

  1. CUSTOMER ACCOUNTS

You may be able to create a customer account. You are responsible for providing accurate information and keeping your login details confidential.

You must notify us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in material breach of these Terms. This does not affect rights relating to orders already accepted.

  1. PRODUCT INFORMATION

We take reasonable care to ensure product descriptions, photographs, prices and availability are accurate.

Product colours and appearance may vary slightly because of screen settings, photography, lighting and normal manufacturing variations. Product packaging may also be updated by a manufacturer without notice, provided the product supplied remains materially as described.

Minor manufacturing or packaging variations are not automatically defects. This does not affect your rights where goods are faulty, damaged, counterfeit, misdescribed, not of satisfactory quality or not fit for purpose.

All products are subject to availability. Placing an item in your basket does not reserve it.

  1. TRADING CARDS AND COLLECTIBLES

Trading card products may contain randomly selected cards or other randomly allocated contents determined by the manufacturer.

Unless expressly stated on the product page, purchasing a booster pack, booster box, collection box, tin or other randomised product does not guarantee:

  • A particular card, rarity or pull.

  • A particular number of hits.

  • A particular pull rate.

  • Any minimum resale, grading or investment value.

  • A particular grade from PSA, BGS, CGC, ACE or another grading company.

Published pull rates and community estimates are not guarantees unless expressly guaranteed by the manufacturer.

The market value of cards and collectibles may rise or fall. We do not provide financial or investment advice and do not guarantee future values.

Where a product is described as factory sealed, it will be supplied with the manufacturer’s seal intact unless the product page clearly states otherwise.

  1. THIRD-PARTY BRANDS AND GRADING

Pokémon, One Piece, PlayStation, Xbox, Turtle Beach and other product names, logos and trademarks belong to their respective owners.

Their appearance on our website identifies the genuine branded products being offered and does not imply sponsorship or endorsement of Pixel & Pull unless expressly stated.

Where a card or collectible has been graded by a third-party grading company, the grade is that company’s independent opinion. We are not responsible for later changes to grading standards, population reports or market values.

  1. ORDERS AND CONTRACT FORMATION

When you place an order, you are making an offer to purchase the selected products.

An automated order confirmation confirms that we received your order. It does not necessarily mean that we have accepted it.

A contract is formed when we send a dispatch confirmation or otherwise confirm that the order has been accepted.

Before acceptance, we may decline or cancel an order for legitimate reasons, including:

  • The product is unavailable.

  • Payment is not authorised.

  • The delivery address is invalid or outside an area we serve.

  • We reasonably suspect fraud or unlawful activity.

  • A price or product description contains an obvious error.

  • Purchase limits stated on the website have been exceeded.

If payment has already been taken for an order we cannot accept, we will refund it using the original payment method.

After a contract has been formed, we will only cancel where permitted by these Terms or by law.

  1. PRICES, VAT AND PAYMENT

All prices displayed to UK consumers are in pounds sterling and include VAT where applicable.

Delivery charges are displayed separately before payment.

Standard tracked UK delivery costs £3.95 for orders below £99.99 and is free for orders of £99.99 or more.

We may change prices at any time, but changes will not affect an order already accepted.

If we discover an obvious pricing error before accepting an order, we will contact you and give you the choice of purchasing at the correct price or cancelling the order.

Payment must be made using a payment method offered at checkout. You confirm that you are authorised to use the selected payment method.

Payment processing may be provided by Shopify Payments or another authorised payment provider. We do not receive or store your complete payment-card details.

  1. PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes are subject to any additional conditions stated when they are offered.

Unless expressly stated otherwise:

  • Discount codes cannot be exchanged for cash.

  • Only one discount code may be used per order.

  • Codes cannot be applied retrospectively.

  • A promotion may be withdrawn before an order is accepted.

  • Discounted and sale products retain the same statutory rights as full-price products.

We may refuse or cancel the use of a promotion where we reasonably believe it has been obtained or used fraudulently or contrary to its stated conditions.

  1. SHIPPING AND DELIVERY

Orders placed before 12:00 noon Monday to Friday are normally dispatched the same working day.

Orders placed after 12:00 noon, during weekends or on UK bank holidays are normally dispatched the next working day.

Smaller parcels are normally sent using Royal Mail Tracked 24 and usually arrive within 1–2 working days after dispatch.

Larger or higher-value parcels may be sent using DPD and usually arrive on the next working day after dispatch.

Delivery times are estimates unless expressly guaranteed at checkout. Delays may occur because of severe weather, carrier disruption, unusually busy periods or other circumstances outside our reasonable control.

We will deliver within 30 days after the contract is formed unless another timeframe has been agreed with you.

  1. DELIVERY ADDRESS AND FAILED DELIVERY

You are responsible for providing a complete and accurate delivery address.

Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.

If an order is returned to us because an incorrect or incomplete address was supplied, or because delivery was repeatedly refused or not collected, we may charge the actual reasonable cost of redelivery. Your statutory rights remain unaffected.

  1. DELIVERY RISK AND OWNERSHIP

We remain responsible for the goods while they are being delivered by a carrier arranged by us.

Risk passes to you when the goods are delivered into your physical possession or to a person identified by you to receive them.

Ownership passes to you once we have received full payment and the goods have been delivered.

If tracking states that a parcel has been delivered but you cannot locate it, contact us promptly so we can investigate with the carrier.

  1. CANCELLING AN ORDER BEFORE DISPATCH

Contact support@hyperstockuk.co.uk immediately if you wish to cancel an order before dispatch.

We will try to accommodate the request, but cancellation cannot be guaranteed once the order has entered processing or has been dispatched.

If the order has already been dispatched, the cancellation and returns provisions below will apply.

  1. UK CANCELLATION RIGHTS

For most online purchases, UK consumers may cancel without giving a reason by notifying us within 14 days after the goods are received.

Where an order contains multiple products delivered separately, the cancellation period normally ends 14 days after the final product is received.

After notifying us of cancellation, you must return the goods within a further 14 days.

To cancel, email support@hyperstockuk.co.uk with your name, order number and a clear statement that you wish to cancel.

You are responsible for the direct cost of returning change-of-mind purchases unless we agree otherwise.

When an entire eligible order is cancelled, we will refund the product price and the cost of our least expensive standard delivery option. Additional amounts paid for premium or expedited delivery are not refundable beyond the cost of standard delivery.

We may withhold the refund until we receive the returned goods or you provide evidence that they have been returned.

Refunds will be issued within 14 days after we receive the returned goods or acceptable evidence of return, using the original payment method unless agreed otherwise.

  1. VOLUNTARY 30-DAY RETURNS

In addition to statutory cancellation rights, we offer a voluntary 30-day change-of-mind return period beginning on the day of delivery.

To qualify under this voluntary policy, products must be unused, in their original condition and returned with their original packaging, accessories and components.

Proof of purchase is required.

This voluntary policy does not reduce or replace your statutory rights.

  1. OPENED TRADING CARD PRODUCTS

Due to the collectible nature of trading card products and the significant reduction in value caused when a factory seal is broken, opened trading card products cannot be accepted under our voluntary change-of-mind returns policy.

This includes booster packs, booster boxes, Elite Trainer Boxes, collection boxes, tins and other products sold as factory sealed.

To qualify for a voluntary return, the product’s original factory seal must remain completely intact. Opening the external delivery parcel does not count as breaking the product’s factory seal.

This condition does not affect statutory rights where a product is faulty, damaged, counterfeit, misdescribed or incorrectly supplied.

Where a statutory cancellation right applies but a customer has handled a product beyond what is reasonably necessary to inspect it, we may make a lawful deduction reflecting the product’s actual reduction in value. For factory-sealed collectibles, breaking the seal may cause a substantial reduction in value.

  1. FAULTY, DAMAGED OR INCORRECT GOODS

Goods must be as described, of satisfactory quality and fit for purpose.

Inspect your order after delivery and contact support@hyperstockuk.co.uk promptly if a product is:

  • Faulty.

  • Damaged.

  • Counterfeit.

  • Misdescribed.

  • Missing.

  • Incorrectly supplied.

Please include your order number and clear photographs of the product, delivery packaging and shipping label where relevant.

Do not discard the product or packaging until we have advised you.

Depending on the circumstances and applicable law, you may be entitled to a refund, repair or replacement. We will cover reasonable return costs for faulty, damaged or incorrectly supplied goods.

Nothing in these Terms affects rights under the Consumer Rights Act 2015.

  1. RETURNS ADDRESS

Contact us before returning anything. Items sent without prior contact may take longer to identify and process.

We recommend using a tracked return service and retaining proof of postage. You remain responsible for change-of-mind returns until they are delivered to us.

  1. REFUNDS

Approved refunds will be made to the original payment method unless agreed otherwise.

Banks and payment providers may require additional processing time after we issue a refund.

We may make a lawful deduction where:

  • A returned product has been handled beyond what is reasonably necessary to establish its nature, characteristics and functioning.

  • The product has been used or damaged after delivery.

  • Parts, accessories or original packaging are missing.

  • The factory seal of a collectible product has been broken, causing an actual reduction in its value.

Any deduction will be based on the actual reduction in value and will not affect remedies available for faulty, damaged, counterfeit, misdescribed or incorrectly supplied goods.

  1. WEBSITE AVAILABILITY

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted access.

We may temporarily suspend or change parts of the website for maintenance, security, technical or operational reasons.

We are not responsible for temporary unavailability caused by circumstances outside our reasonable control. This does not affect accepted orders or statutory rights.

  1. INTELLECTUAL PROPERTY

The Pixel & Pull name, website design, original text, graphics, photographs, logos and other content created by or for us are owned by or licensed to HYPERSTOCKUK LTD.

You may use the website for personal shopping and reference purposes.

You must not reproduce, republish, sell, commercially exploit or create derivative works from our original website content without written permission, except where permitted by law.

Third-party product images, names, logos and trademarks remain the property of their respective owners.

  1. REVIEWS AND CUSTOMER CONTENT

If you submit a product review, photograph or other content to us, you confirm that:

  • The content is honest and based on your genuine experience.

  • You own it or have permission to submit it.

  • It does not infringe another person’s rights.

  • It is not unlawful, threatening, defamatory, obscene, fraudulent or misleading.

  • It does not contain malicious software or confidential personal information.

You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use it in connection with operating and promoting Pixel & Pull.

We may moderate or remove content where reasonably necessary for legal, security or platform-policy reasons.

  1. THIRD-PARTY SERVICES AND LINKS

Our website is hosted by Shopify. Shopify and other providers may supply services including website hosting, payment processing, customer accounts, analytics and checkout functions.

Your purchase contract is with HYPERSTOCKUK LTD, not Shopify.

Our website may contain links to independent third-party websites. We are not responsible for their content, availability, security or privacy practices. You should review their terms and policies before using them.

  1. PRIVACY

We process personal information in accordance with our Privacy Policy:

The Privacy Policy explains what information we collect, why we use it, who we share it with, how long we retain it and the rights available to you.

  1. OUR RESPONSIBILITY TO YOU

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence.

  • Fraud or fraudulent misrepresentation.

  • Defective products where liability cannot lawfully be excluded.

  • Breach of statutory consumer rights.

  • Any other liability that cannot lawfully be excluded or limited.

We supply products primarily for private and domestic use. We are not responsible for business losses, loss of profit, loss of revenue or loss of business opportunity arising from consumer purchases, except where the law does not permit such exclusion.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by an event outside our reasonable control, including severe weather, carrier disruption, industrial action, power or communications failure, cyberattack, government action or natural disaster.

We will take reasonable steps to reduce the effects of the event and will contact affected customers where appropriate.

If a material delay continues, you may have the right to cancel and receive a refund for products not supplied.

  1. CHANGES TO THESE TERMS

We may update these Terms to reflect legal, regulatory, technical or operational changes.

The latest version will be published on this page with an updated revision date.

Changes will apply prospectively and will not alter the terms governing an order already accepted unless required by law or agreed with you.

  1. TRANSFER OF RIGHTS

We may transfer our rights or obligations under these Terms as part of a business sale, restructuring or transfer, provided this does not reduce your rights.

You may transfer your rights where permitted by law. We may require reasonable evidence that a person claiming under your order has authority to act for you.

  1. SEVERABILITY

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

  1. NO WAIVER

If we delay enforcing a right, this does not mean that we have waived it.

  1. ENTIRE AGREEMENT

These Terms, together with the product description, order confirmation, Privacy Policy, Refund Policy and Shipping Policy, form the agreement between you and us for your purchase.

Nothing in this section excludes liability for fraud or removes any statutory consumer right.

  1. GOVERNING LAW AND COURTS

These Terms and purchases made through our website are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you retain the protection of any mandatory consumer laws that apply where you live and may bring proceedings in the courts available to you under applicable law.
